Terms of Service

Welcome to PianoKitty — a browser app that helps you learn piano chords and scales through short, playful, gamified exercises. These Terms are a contract between you and the operator named below. By using PianoKitty you agree to them. If you do not agree, please do not use the app.

1. Who we are

PianoKitty ("the app", "the Service", "we", "us") is operated by:

2. What PianoKitty is for

Our goal is to make music education easy to reach and fun to stick with. The app aims to:

  • give everyone easy access to music education;
  • make learning chords, scales and notation simple and enjoyable;
  • encourage you to practice little and often;
  • make communication between teachers and students easier.

PianoKitty is an educational tool, not professional musical, medical, or other advice. Results depend on your own practice.

3. Early-stage software — use at your own risk

PianoKitty is new and evolving. It may contain bugs, change frequently, be interrupted, or occasionally lose data. Features can appear, change, or disappear without notice. We provide the app on an "as is" and "as available" basis and you use it at your own risk. Found a problem or have an idea? Please tell us on the bug & feedback page.

4. Who may use it (age & children)

You must be at least 13 years old to create your own account. A child under 13 may use PianoKitty only through a separate child account created and supervised by their parent or legal guardian. By creating a child account, the parent/guardian confirms they hold parental responsibility for that child and consent to our processing of the child's data as described in our Privacy Policy. The parent/guardian is responsible for supervising the child's use and may delete the child account at any time.

5. Using the app without an account

You can use PianoKitty without signing in. In that mode your settings and progress are stored only in your browser (local storage) on your device and are not sent to our servers. Clearing your browser data will erase them.

6. Accounts

  • You can register with an e-mail and password, or sign in with Google, Facebook or Apple.
  • Provide accurate information and keep your password confidential. You are responsible for activity under your account.
  • Tell us promptly (via the contact page) if you suspect unauthorized use.
  • Child accounts are managed by the responsible adult who created them.

7. Price — free, non-profit (for now)

PianoKitty is currently free and run on a non-profit basis. This model may change in the future, but there will always be a free tier. Any "Pro" label in the app today is simply a feature flag and involves no payment. If we ever introduce paid features, we will present the terms and price before you buy.

8. Acceptable use

When using the Service, you agree not to:

  • break the law or infringe anyone's rights;
  • upload or share unlawful, hateful, harassing, deceptive or harmful content in free-text areas (e.g. notepads, profile bio, bug reports, shared exercises or messages);
  • misuse relationships, invitations, sharing or messaging to spam, harass or contact people who don't want contact;
  • attempt to break, overload, probe, scrape or reverse-engineer the Service;
  • impersonate others or misrepresent your affiliation.

We may remove content or suspend accounts that break these rules.

9. Your content

You keep ownership of the content you create (notepads, profile text, custom exercises, messages). You grant us a non-exclusive, worldwide, royalty-free license to host, store, display and process that content solely to operate and provide the Service to you (including sharing it with the people you choose to share it with). You are responsible for your content and confirm you have the right to use it.

10. Our intellectual property

PianoKitty's name, branding, design, and its original concepts — including the exercise-card system, parametric exercises, the rotating staff, the jumper and other practice games, the gamification, and the overall layout and look & feel — are protected by copyright and other rights and belong to the operator. You may use the app for your personal or teaching use, but you may not copy, reproduce, adapt or create derivative works of these concepts or materials without our prior written permission.

11. Third-party services

Some features rely on or connect to third parties — for example signing in with Google, Facebook or Apple, and optional extras you can switch on such as cat-image rewards, a reward endpoint you configure yourself, or videos you embed from YouTube/Vimeo. Those services have their own terms and privacy practices, and we are not responsible for them. Enabling an optional feature is your choice.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, uninterrupted or error-free operation, or compatibility with your device, browser or MIDI hardware. You assume the risks of using early-stage software.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for lost data, profits or goodwill, arising from your use of (or inability to use) the Service. Because the app is provided free of charge, our total liability to you is limited to the amount you paid us to use it (which is normally zero).

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law — including liability for death or personal injury caused by negligence, for fraud, or your mandatory rights as a consumer. Those rights are unaffected.

14. Indemnity

You agree to hold us harmless from claims and costs arising out of your misuse of the Service or your breach of these Terms, to the extent permitted by law.

15. Suspension, termination & deleting your data

You may stop using the app at any time. You can delete your account and data — just contact us (see below or the contact page) and we will delete them. We may suspend or terminate accounts that breach these Terms or the law, or where needed to protect users or the Service.

16. Changes to the Service and these Terms

We may update the Service and these Terms as the app evolves. When we make material changes we will update the date above and, where appropriate, notify you in the app. Continuing to use PianoKitty after changes take effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the law of Poland, and disputes are subject to the competent Polish courts — without depriving you of the protection of mandatory consumer-law provisions of the country where you live.

18. General

If any provision is found unenforceable, the rest remain in force. These Terms and the Privacy Policy are the entire agreement between us regarding the Service. Our failure to enforce a provision is not a waiver. We may transfer our rights and obligations in connection with a reorganization or transfer of the Service; your rights are not affected.
